Section 205 of the Body Corporate and Community Management Act 1997 (Qld) allows interested persons (which includes owners and buyers) to inspect and/or get copies of body corporate records.

The fees are set by the regulation module applying to the scheme.

Once a request has been made, and the fee paid, the body corporate has 7 days to permit the inspection or provide copies.

An interested person does not have to give a reason for the request.

Concern about privacy, such as the inspection or giving of a roll containing owners’ contact details, is not a basis to refuse access.

The only bases to refuse access or copies of body corporate records are where the document (or part of it): 

  1. is legally professionally privileged; or
  2. contains defamatory material.
