  • Acting for one of Queensland’s largest privately owned property developer in Supreme Court (including appeal and special leave application to the High Court) litigation concerning capacity of a contracting party to hold a nominee to the contact bound by the contract and its post-contractual obligations.

  • Defending a transportation company in Supreme Court proceedings involving a myriad of issues including delay in bringing the proceeding against our client, equitable relief, competing equities and postponement of priorities, trusts, bankruptcy and abandonment of security, the Duties Act and Trade Practices Act

  • Representing the liquidators of a construction company in complex commercial and construction proceedings involving a myriad of issues including, adjudication of proofs of debt, leave to proceed against a company in liquidation (section 471B of the Corporations Act), equitable liens of solicitors, and BICIPA claims.

  • Representing a public listed entity in a Federal Court Proceeding to obtain orders authorising a takeover by Scheme of Arrangement.

  • Acting for a client defending a claim by WorkCover Queensland against a construction company exceeding $150,000.00 in unpaid WorkCover premiums, penalties and interest.  The result of our involvement was a refund from WorkCover to the client.

  • Representing a high net worth family in defamation proceedings to obtain urgent Anton Pillar Orders (ex parte search and seizure orders) in the Supreme Court of Victoria and obtaining judgment in excess of $3 million.

  • Applications for the appointment of Statutory Trustees pursuant to the Property Law Act 1974 (Qld) in unusual circumstances; such as by a mortgagee of the property and trustees in bankruptcy.

  • Recovery actions on behalf of mortgagees in Victoria, Western Australia and Queensland, successfully recovering loan funds, possession and sale of secured assets under mortgages.

  • Representing interests of both medium and large banking institutions in relation to secured and unsecured recoveries, appointment of receivers and managers pursuant to registered mortgage debentures and drafting associated demands and appointment documents.

  • Defending Trustees in Bankruptcy in a Federal Court Proceeding regarding complex trust and self-managed superannuation fund including representing the Trustees in Bankruptcy in urgent Injunctive proceedings brought by the Commissioner for Taxation and related proceedings on Appeal to the Full Federal Court.

  • Review of collections policies for Aged Care Provider including amendments to current agreements and policies.
